Court rejects APC’s bid to stop Kano LG polls

A Federal High Court in Kano has rejected the All Progressives Congress’s bid to halt the upcoming Local Government elections in Kano State.

 

The APC, along with Hon. Aminu Aliyu Tiga, filed an exparte motion seeking to restrain the Kano State Independent Electoral Commission from conducting the elections.

 

The motion, filed through their counsel, Mustapha Idris Esq, N. A. Isa Esq, and I. A. Alhassan Esq, requested the court to grant an injunction order directing all parties to maintain the status quo and refrain from further actions regarding the election’s preparation and conduct. However, Presiding Judge Justice Simon Amobeda denied the APC’s prayers, stating that the defendants must be notified to show cause why the prayers should not be granted.

 

The defendants in the suit include KANSIEC, its Chairman Prof. Sani Lawal Malumfashi, the Kano State House of Assembly, the Kano State Attorney General, the Kano State Commissioner of Police, INEC, DSS, NSCDC, and six others.

 

According to the court order, “prayers 1 and 2 are refused in the interim to the extent that the Defendants shall be put on Notice to show cause why these prayers shall not be granted.”

 

Additionally, the court granted prayer three and abridged the time for hearing the substantive application to five days from the date of service

 

Justice Amobeda ordered accelerated hearing of the case, directing parties to promptly file necessary processes to expedite the matter’s resolution. The court also warned parties against taking any action that could prejudice the hearing and quick determination of the matter.

 

The case has been adjourned to October 4, 2024, for hearing. Notably, KANSIEC had previously secured a court order restraining the APC and 18 other political parties from disrupting the local government elections scheduled for October 26, 2024.
