Adamawa State Government has filed a lawsuit at the Supreme Court, challenging the federal government’s alleged unconstitutional deductions from the Federation Account.
The state seeks a definitive interpretation of Section 162 (1), (2), and (3) of the constitution, which governs revenue distribution among all tiers of government.
The government argues that the entire sum in the Federation Account must be distributed without deductions, except as permitted by law, and that the president must strictly comply with the Constitution in managing and distributing revenue, according to Politics Nigeria.
Adamawa State seeks a declaration from the Supreme Court that any deductions or withholdings made without constitutional backing be declared unconstitutional.
The state government emphasizes that the federal government’s discretion to manage revenue is limited to only what is expressly permitted by the Constitution.
The lawsuit aims to ensure that revenue distribution is conducted without arbitrary deductions or withholdings by the federal government, and to secure a strict interpretation of the constitution.
