A court of appeal in Abuja has thrown off an appeal seeking for Labour Party presidential contender, Peter Obi’s disqualification from participating in the upcoming election.
The appeal marked CA/ABJ/CS/1424/2022, filed by Allied People Movement against the Independent National Electoral Commission , the Labour Party and its presidential candidate, Peter Obi was on Wednesday struck off on the grounds that it iwas devoid of merit.
Justice Ogochukwu Ogakwu said that from the evidence before the court, the appeal was devoid of merit, same failed and deserved to be struck out, adding that appellant did not make the list of members of the Labour Party available to the court and that the court is not supposed to look for evidence for the appellant, according to Tribune.
The judge further stressed that the appellant could not prove that the respondents violated the Electoral Act and no evidence raised could meet up the condition of disqualifying the Labour Party presidential aspirant.
