The Supreme Court in Abuja has fixed January 15, 2024, to hear the petition submitted by the 2023 Governorship candidate of the All Progressives Congress in Rivers state, Patrick Tonye-Cole, against the Independent National Electoral Commission, Governor Siminalayi Fubara, and the Peoples Democratic Party in the State.
Tonye-Cole who is challenging the victory of Governor Siminalayi Fubara of the Peoples Democratic Party in the Mach 18 Governorship Election in the state, prayed the court to sack Fubara as governor for failing to resign as Accountant General of the state after emerging as the candidate of PDP in the last election.
Similarly, the APC candidate had also argued that Fubara was not qualified to contest the last election, let alone be declared the winner of the election.
Tonye-Cole in his suit, is also asking the court to cancel elections in some local government areas over allegations of irregularities or he should be declared the winner of the election.
It would be recalled that the APC candidate’s suit was dismissed at the tribunal for lacking merit on all grounds but won some of the grounds at the Court of Appeal.
However, he approached the Apex Court, seeking to set aside the judgement given by the Appeal Court, which upheld the victory of the governor.
